Terms of Service

By using a Water Fountain machine or completing our SMS or verification (collectively, the “Service”), you agree to these Terms of Service (“Terms”).

If you do not agree, please do not use the Service.
 
1. Who can use Water Fountain
You must be the age of majority in your province or territory, or have permission from a parent or legal guardian, to use the Service.
If you provide a phone number for verification, you confirm:

• The number belongs to you, and

• You are authorized to receive messages at that number.

 
2. What Water Fountain provides
Water Fountain provides free cans of natural spring water through automated machines.

Personal use only — not for resale.

Water dispensed through the Service is for individual consumption only and may not be resold, redistributed, traded, or bartered.
Machines may display advertising on:
 

• Can labels,

• On-screen displays,

• QR codes or linked pages, or

• Transactional messages (“Ad Content”).
   

We may limit quantities per person or per day, apply location-based restrictions, or temporarily pause machines for maintenance, safety, inventory, or security reasons.
 
3. Advertisers & third-party offers (important)
Water Fountain does not sell or provide third-party products or services advertised through the Service.
 

• No endorsement. We do not endorse or guarantee any advertiser, offer, claim, price, promotion, or coupon.

• Your relationship is with the advertiser. Any purchase, redemption, refund, or dispute is solely between you and the advertiser.

• Third-party terms apply. Advertisers and linked sites have their own terms and privacy practices, which we do not control.
   

4. Health, safety & product condition (important)
Our water is sourced and canned by licensed third-party suppliers responsible for manufacturing and quality control.
Do not consume the product if:
 

• The can appears damaged, swollen, leaking, or tampered with,

• It is past any printed best-before date, or

• You are unsure of its safety.
   

Medical considerations.
If you believe a product caused illness, stop using it, seek medical advice, and notify us.

Recalls & safety notices.
If required, we will issue safety alerts or recalls and contact you if we have your information.
 
5. No warranties
To the fullest extent permitted by law, the Service—including machines, water, software, Ad Content, and related information—is provided “as is” and “as available.”

We disclaim all express or implied warranties, including warranties of merchantability, fitness for a particular purpose, and accuracy, except where such disclaimers are prohibited by law.
 
6. Limitation of liability
To the fullest extent permitted by law:
 

• Water Fountain and its directors, officers, employees, and suppliers are not liable for indirect, incidental, special, consequential, exemplary, or punitive damages, including lost profits, data, goodwill, or business interruption.
   

• Total liability cap: Our total liability for all claims related to the Service will not exceed $100 CAD.
   

Nothing in these Terms limits liability for gross negligence, wilful misconduct, or personal injury caused by proven negligence where such limits are prohibited by law.
 
7. Acceptable use & machine conduct
You agree not to:
 

• Damage, vandalize, tip, open, or tamper with Water Fountain machines or electronics,

• Bypass limits or anti-abuse systems,

• Use fake identities or multiple phone numbers,

• Interfere with others or building operations, or

• Use the Service for fraud, resale, or unlawful purposes.
   

We may suspend or block access by user, device, or phone number if misuse is suspected.
 
8. Verification, accounts & communications
Some machines require SMS or account verification.
By providing contact details, you agree to receive transactional messages only, such as:
 

• Access or PIN codes,

• Redemption confirmations,

• Safety or recall notices, and

• System updates.
   

Marketing messages (if offered) require separate consent and can be opted out of at any time. Standard carrier rates may apply.
 
9. Privacy & data use
Your use of the Service is governed by our Privacy Policy, which explains:
 

• What data we collect (e.g., phone number, usage events, device signals, coarse location),

• Why we collect it (verification, abuse prevention, analytics, safety notices),

• How long data is retained and where it is stored,

• Who it may be shared with (e.g., infrastructure providers), and

• Your rights under BC’s Personal Information Protection Act (PIPA).
   

Optional demographic data.
If demographic information (such as age range or gender) is ever requested:
 

• It will be optional,

• Include a “Prefer not to say” option, and

• Be used only in aggregated, anonymous reporting.

10. Fraud, abuse & false claims
Fraudulent use, abuse, or knowingly false claims (including false illness reports) may result in suspension, banning, or legal action. We reserve the right to investigate misuse.
 
11. Intellectual property
All Water Fountain branding, designs, machines, and software are owned or licensed by us.

You may not copy, modify, reverse-engineer, or extract any part of the Service. Advertiser trademarks belong to their respective owners.
 
12. Feedback
If you submit feedback or suggestions, you grant Water Fountain a worldwide, royalty-free right to use them without obligation or compensation.
 
13. Service availability & changes
The Service may be interrupted or modified due to maintenance, supply limits, connectivity iss-ues, or operational needs.

We may update these Terms at any time. Continued use after updates means you accept the revised Terms.
 
14. Property rules & local laws
Use of the Service is subject to building rules, posted signage, and applicable local laws. Please recycle where facilities exist.
 
15. Indemnification
You agree to indemnify and hold Water Fountain harmless from claims arising out of:
 

• Your misuse of the Service,

• Your violation of these Terms, or

• Your interactions with advertisers.
   

 
16. Governing law
These Terms are governed by the laws of British Columbia and Canada. Any legal proceedings must be brought in British Columbia.
 
17. Severability & assignment
If any part of these Terms is found unenforceable, the remaining provisions remain in effect.

We may assign these Terms. You may not without our consent.
